Edwards Information, LLC (d/b/a Edwards Disaster Recovery Directory) (the “Company”, "us", "we" or "our") created this Privacy Policy ("Privacy Policy") in order to ensure the confidence of visitors and users (“user”, "you" or "your") of and to our web site (the "Site"), and to demonstrate our commitment to fair information practices and the protection of privacy.

Types of Information Collected

Your Personal Information is stored on secure servers that are not accessible by third parties. We provide you with the capability to transmit your Personal Information via secured and encrypted channels if you use a similarly equipped web browser.
We may use Personal Information to send you information about our company and services, or promotional material from some of our business partners, or to contact you when necessary.
We use your Financial Data to bill you for our services.
We use Traffic Data to analyze trends, administer the Site, track user’s movement within the Site, and gather broad demographic information for aggregate use.
Notwithstanding the foregoing, we may transfer, sell or assign information concerning your use of this Site, including without limitation, Personal Information, to third parties, as a result of the sale, merger, consolidation, change in control, transfer of substantial assets, reorganization or liquidation of the Company, or with approved marketing partners.

Security

The Site has security measures in place to protect the loss, misuse and alteration of the information under our control. All Site and Personal Information is kept with our security host, ValueWeb, which maintains highly secured facilities and will abide by the terms of this Privacy Policy. In addition, all credit card information is stored in encrypted form.
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, we cannot ensure or warrant the security of any information you transmit to us or from our online services, and you do so at your own risk. Once we receive your transmission, we make reasonable efforts to ensure security on our systems.

Notification of Changes

If we decide to change our Privacy Policy, we will post those changes on our home page so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Definitions

(a) "Edwards Disaster Recovery Directory" means the software program contained on the enclosed media.

(b) "Edwards Information, LLC" means the owner/licensor of the Edwards Disaster Recovery Directory and all related updates supplied by or on behalf of Edwards Information, LLC.

License

This Agreement provides you with a non-exclusive, royalty-free, world-wide license which allows you to:
(a) Use the Edwards Disaster Recovery Directory on a single computer.

(b) Certain rights are not granted under this Agreement, but may be available under a separate agreement. If you would like to enter into an OEM, Site or Network License, please contact Edwards Information, LLC. No other rights are provided under this Agreement.

Restrictions

You may not decompile, reverse engineer, disassemble, or otherwise reduce the Edwards Disaster Recovery Directory to a human-perceivable form. You may not modify, sell, rent, transfer, resell for profit, distribute or create derivative works based upon the Edwards Disaster Recovery Directory or any part thereof.

Ownership

This license gives you limited rights to use the Edwards Disaster Recovery Directory. You do not become the owner of, and Edwards Information, LLC and its suppliers retain all title to, the Edwards Disaster Recovery Directory, and all copies thereof. All rights not specifically granted in this Agreement, including rights under Federal and International Trademarks, Copyrights and Patents are reserved by and to Edwards Information, LLC

Disclaimer of Warranties and of Technical Support

The Edwards Disaster Recovery Directory software is provided to you on an "AS IS" basis, without any technical support or warranty of any kind from Edwards Information, LLC. Accordingly, Edwards Information, LLC EXPRESSLY DISCLAIMS, without limitation, ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH VARY FROM STATE TO STATE. These limitations and exclusions of warranties and liability do not affect or prejudice the statutory rights of a consumer; that is, a person acquiring goods other than in the course of a business.

Limitation of Liability and Damages

A. UNDER NO CIRCUMSTANCES SHALL EDWARDS INFORMATION, LLC BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LOSS (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF EDWARDS INFORMATION, LLC OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. The disclaimer of warranty, exclusions, and limitations of liability set forth above are essential elements of the basis of the bargain between Edwards Information, LLC and you.

B. THE Edwards Disaster Recovery Directory CONTAINS LINKS TO THIRD PARTY WEB SITES AS AN INTEGRAL PART OF ITS OPERATION. UNDER NO CIRCUMSTANCES SHALL EDWARDS INFORMATION, LLC BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LOSS (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF EDWARDS INFORMATION, LLC OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES CAUSED DIRECTLY OR INDIRECTLY BY CONTACT OR INTERACTION WITH SUCH SITES.

RESTRICTED RIGHTS LEGEND The Edwards Disaster Recovery Directory Software is "Restricted Computer Software." Use, duplication, or disclosure by the U.S. government is subject to restrictions as set forth in this Agreement and as provided in DFARS 227.7202-1(a) and 227.7202-3(a) (1995), DFARS 252.227-7013 (OCT 1988), FAR 12.212(a) (1995), FAR 52.227-19, or FAR 52.227-15 as applicable.

General

This Agreement shall be governed by the laws of the State of Maryland. This Agreement constitutes the complete agreement between the parties with respect to the use of the Edwards Disaster Recovery Directory and supersedes all prior or contemporaneous agreements or understandings, whether oral or written. No amendment or modification of this Agreement shall be binding unless in writing and signed by Edwards Information, LLC.

All other trademarks not owned by Edwards Information, LLC that appear in this publication are the property of their respective owners. All trademarks and/or trade dress are protected by state, federal and local laws of the United States and international laws protecting trademarks and/or trade dress. The trademarks and/or trade dress appearing in this publication may not be used in connection with any product or service that is not the respective trademark or trade dress owner’s, in any manner that is likely to cause confusion among existing or potential customers, or in any manner that disparages or discredits the respective owners of such trademarks and/or trade dress.
